Commercial Learner's Permit (CLP) Rules 2026: Restrictions & Laws

Congratulations! You studied hard, passed the General Knowledge, Air Brakes, and Combination tests, and walked out of the DMV with your Commercial Learner's Permit (CLP).
You might feel ready to hit the road, but STOP.
A CLP is not a "Junior License." It is a strictly regulated permit with severe limitations. Driving on a CLP incorrectly can result in you being barred from getting a CDL for a year or more.
This 2026 guide explains the Federal Motor Carrier Safety Administration (FMCSA) rules (specifically 49 CFR 383.25) that govern what you can and cannot do.
1. The "Front Seat" Requirement
This is the most violated rule.
- The Rule: You must be accompanied by the holder of a valid CDL.
- The Position: That CDL holder must physically sit in the front passenger seat next to you at all times while you are driving.
- They cannot be in the sleeper berth.
- They cannot be following you in a car.
- The Qualifications: The passenger must have a CDL of the same Class or higher with the same Endorsements necessary for the vehicle.
- Example: If you are driving a Tanker, your instructor MUST have the 'N' endorsement. If they don't, you are driving illegally.
2. Mandatory Restrictions on Every CLP
When you get your permit, you will notice specific "Restriction Codes" printed on it. These are mandatory until you pass the road test.
P - No Passengers in CMV Bus
- What it means: If you are training for a passenger endorsement (Bus), you cannot have actual passengers in the vehicle.
- Who is allowed: Only the instructor, other student drivers, and examiners. No paying customers.
X - No Cargo in CMV Tank Vehicle
- What it means: If you are training in a tanker, the tank must be empty.
- The Purge: It's not enough to be empty; if it previously held HazMat, it must be purged of residue. You cannot haul a load of water or milk for training purposes on public roads if you only have a permit.
3. Interstate vs. Intrastate on a Permit
This is a gray area that confuses many.
- Can I drive across state lines? YES.
- The Condition: As long as you have your CLP and a valid Medical Card, you can drive Interstate (between states) for training purposes.
- The Trap: You cannot drive "For Hire" in a way that classifies you as a solo operator. Since you are with a trainer, the load belongs to the trainer/company. You are just the student.
4. The 14-Day Waiting Period
You cannot get your permit on Monday and take the road test on Tuesday.
- Federal Law: You must hold the CLP for 14 days before taking the skills test.
- Why? This forces you to get at least two weeks of practice.
- Expiration: Most CLPs are valid for 180 days or 1 year (depending on the state). If it expires, you may have to retake the written tests.
5. Practice Scenarios: Legal or Illegal?
The Logic: The accompanying driver must have a license valid for the vehicle being driven. A Class B holder is NOT licensed to drive a Class A vehicle. Therefore, they cannot legally supervise you. You are effectively driving without a license.
The Logic: The law requires the CDL holder to be in the front passenger seat. They must be alert and able to take control of the vehicle or offer advice instantly. Sleeping in the back disqualifies them as a supervisor.
